§ 2Summary

§2M5.2 (exportation of arms, munitions or military equipment without a licence) was the primary guideline in 1,183 cases sentenced across 8 fiscal years (FY2018–FY2025), 0.2% of all cases, with 169 in FY2025. The Commission classes most of them as national defense.

The median prison term under §2M5.2 was 27 months (2 yr 3 mo) (all cases nationally: 24 months); 90% of cases carried a prison term.
